Adding New Punishments Not Allowed says State Supreme Court

Ryan M. Schiff, a staff lawyer in the Special Litigation Unit of the state public defender agency, said the high court correctly recognized that when a person is “complying with every one of his conditions of probation, a judge can’t impose additional punishment by requiring him to wear a conspicuous GPS device and have his every move monitored by the government.’’

Pa. School District Pays $33,000 to Settle Cell Phone Search Lawsuit

On Wednesday, the ACLU of Pennsylvania settled a lawsuit brought on behalf of a former high school student, known as “N.N.,” whose cell phone was confiscated and unconstitutionally searched by school officials.

The lawsuit charged (PDF) that school officials in Tunkhannock Area School District violated N.N.’s First and Fourth Amendment rights by searching her phone after confiscating it. A teacher had seized the device after the student was seen using it before classes started, but apparently after school rules allowed students to make calls. The solution to protecting society from those who wish to rape or molest, truly anyone who is prone to chronic crime.. is to lock them up and get them treatment. If the treatment fails, put them to death or keep them locked up. The solution is NOT to create a public Humiliating, Shaming, Branding Sex Offender Registry and strap a GPS bracelet on them.

(CNN) — The man charged with killing 9-year-old Jessica Lunsford confessed in 1991 that he tried to molest a 5-year-old girl, telling police “I need help,” according to a tape obtained by CNN.

The suspect, 46-year-old John Evander Couey, was charged this week with capital murder, burglary with battery, kidnapping and sexual battery on a child younger than 12.

Couey had been arrested 25 times previously in Florida — the same state as where he allegedy kidnapped and killed Jessica.

No Charges for Wis. Prosecutor caught sexting offender’s ex-girlfriend for sex

Wis. prosecutor who ‘sexted’ victim won’t resign

CHILTON, Wis. — A Wisconsin prosecutor known for two decades as an advocate for crime victims says he is embarrassed about sending sexually suggestive text messages to a younger woman while he was prosecuting her ex-boyfriend in a domestic abuse case, but will remain in office.

Calumet County District Attorney Kenneth Kratz issued that statement Wednesday after The Associated Press reported on the 30 texts he sent to a 26-year-old woman who had complained to police last year. A police report shows he repeatedly sent Stephanie Van Groll text messages in October 2009 trying to spark an affair.

“Are you the kind of girl that likes secret contact with an older married elected DA … the riskier the better?” Kratz, 50, wrote in one message. In another, he wrote: “I would not expect you to be the other woman. I would want you to be so hot and treat me so well that you’d be THE woman! R U that good?” Read the rest of this entry »

United States Government driving citizens into poverty, 1 in 7 now in poverty!

Census: 1 in 7 Americans live in poverty

WASHINGTON – The ranks of the working-age poor climbed to the highest level since the 1960s as the recession threw millions of people out of work last year, leaving one in seven Americans in poverty.

The overall poverty rate climbed to 14.3 percent, or 43.6 million people, the Census Bureau said Thursday in its annual report on the economic well-being of U.S. households. The report covers 2009, President Barack Obama’s first year in office.

Do not let Police tell you that you cannot video tape them

If you are ever involved in any type of interaction with the police, the best thing you can do is either have someone else videotape it or videotape it yourself.

It has been said, Absolute Power Corrupts Absolutely. This is shown to be a widespread truth concerning Police, Sheriffs and All who are involved in Law Enforcement, the Injustice System and our Government. Watch the video and learn.

Another video, which will send this message home is the below shocking video of a woman who had called police after she was assaulted. The police came to her home and mistakenly ARRESTED HER thinking she was the perpetrator. Warning, some pretty foul language and nudity are shown in the video.

Police arrest the wrong girl, beat her down and strip her naked.

Note: Even with this Video tape showing MEN stripping an innocent woman naked, which violates regulations against opposite sex persons stripping people naked, these police officers who assaulted, beat and stripped naked and left this woman in a cell butt naked for 6 hours.. they were not prosecuted or found to have done anything against the law or policy.

But, the world knows.. and if you use your camera or recording device to record audio or video of any incident involving the Gestapo, the American Police Force.. you will at-least have a chance to prove their wrongdoing.

The Time Has Indeed Come!

Governors of 35 states have already filed suit against the Federal Government for imposing unlawful burdens upon them.  It only takes 38 (of the 50) States to convene a Constitutional Convention.
This will take less than thirty seconds to read. If you agree, please pass it on.

An idea whose time has come!

For too long we have been too complacent about the workings of Congress.  Many citizens had no idea that members of Congress could retire with the same pay after only one term, that they specifically exempted themselves from many of the laws they have passed (such as being exempt from any fear of prosecution for  sexual harassment) while ordinary citizens must live under those laws. The latest was to exempt themselves from the Healthcare Reform … in all of its forms. Somehow, that doesn’t seem logical. We do not have an elite that is above the law.

I truly don’t care if they are Democrat, Republican, Independent or whatever. The self-serving must stop.

A Constitutional Convention – this is a good way to do that. It is an idea whose time has come.  And, with the advent of modern communication, the process can be moved along with incredible speed.  There is talk out there that the “government” doesn’t care what the people think.  That is irrelevant.  It is incumbent on the population to address elected officials to the wrongs afflicted against the populace…you and me.  Think about this…

The 26th amendment (granting the right to vote for 18 year-olds) took only 3 months & 8 days to be ratified!  Why?  Simple!  The people demanded it.  That was in 1971…before computers, before e-mail, before cell phones, etc.
Of the 27 amendments to the Constitution, seven (7) took 1 year or less to become the law of the land…all because of public pressure.

I’m asking each addressee to forward this Email to a minimum of twenty people on their Address list; in turn ask each of those to do likewise.

In three days, most people in The United States of America will have the message. This is one proposal that  really should be passed around.

Proposed 28th Amendment to the United States Constitution:

“Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Senators and/or Representatives; and, Congress shall make no law that applies to the Senators and/or Representatives that does not apply equally to the citizens of the United States .”
